1. Acceptance of Terms
By accessing or using ToneFinder (the “Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all visitors, free-tier users, and paid subscribers.
2. Description of Service
ToneFinder is a web application that uses AI to help guitarists and bassists dial in tones. Core features include identifying gear from user-uploaded photos, organizing gear into virtual signal chains, and providing an AI chat advisor that recommends knob settings for a given sound. Features and AI model behavior may evolve over time.
3. Accounts
You create an account through AWS Cognito using either an email and password or a Google sign-in. You are responsible for keeping your credentials secure and for all activity that occurs under your account. You may delete your account at any time from your profile; we may suspend or terminate accounts that violate these terms.
4. Subscription and Billing
ToneFinder offers a free tier and paid tiers (Starter and Virtuoso) with higher daily quotas for gear detection, chat messages, and AI tokens. Paid plans are billed monthly or annually via our payment processor. We may adjust pricing or quota limits with reasonable advance notice. Subscriptions auto-renew until cancelled.
5. User Content
You retain ownership of the gear photos, chat messages, and signal chain data you provide (“User Content”). By uploading User Content, you grant ToneFinder a limited, non-exclusive license to process, store, and transmit it to third-party AI providers solely to operate and improve the Service. You represent that you hold the rights necessary to share the content you upload.
6. Acceptable Use
You agree not to: (a) scrape the Service or its AI endpoints in bulk, (b) upload content that is illegal, infringing, or abusive, (c) attempt to reverse-engineer, circumvent, or disable the AI safety mechanisms or quota enforcement, (d) share your account credentials, or (e) use the Service to build a competing product.
7. AI-Generated Content
Gear identifications, layout generations, and tone recommendations are produced by AI models and may be inaccurate, incomplete, or unsuitable for your rig. ToneFinder provides these outputs as suggestions only and makes no warranty as to their correctness or fitness for any particular tone, recording, or performance. Use your ears and your judgement.
8. Limitation of Liability
The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, ToneFinder's aggregate liability arising out of or related to the Service is limited to the fees you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
9. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email or in-app notice at least fourteen days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated terms.
